In upstate New York, a $100 billion semiconductor megafab is at the center of a legal battle over water safety. Community groups have filed a petition to void the environmental permits for Micron's massive chip campus in Clay, a suburb of Syracuse, arguing that the project could release toxic PFAS chemicals into the Oneida River watershed.
The lawsuit, brought by Neighbors for a Better Micron and Jobs to Move America, was filed in Albany County Supreme Court under Article 78, a legal mechanism to challenge government decisions. The groups are asking the court to overturn two permits issued by state regulators—one for air emissions and one for wastewater discharge—claiming they fail to protect public health and the environment.
Wastewater permit under fire
The core of the dispute is the wastewater discharge permit for the Oak Orchard Wastewater Treatment Plant, which is undergoing a $1 billion expansion to handle industrial waste from Micron. The permit raises the plant's average daily discharge from 10 million to 30.8 million gallons, and it identifies 40 different PFAS compounds. However, the plaintiffs argue that the permit only requires quarterly monitoring, not enforceable limits. Even if PFAS levels exceed action thresholds, the chemicals could still flow into the Oneida River without any legal consequence.
“This is about ensuring that our water stays clean for generations to come,” said a spokesperson for Neighbors for a Better Micron. “We're not against progress, but we need safeguards that actually work.”
PFAS, or per- and polyfluoroalkyl substances, are known as 'forever chemicals' because they don't break down in the environment. They are used extensively in semiconductor manufacturing, particularly in photolithography, where their resistance to heat and chemical reactions is essential. There are currently no viable commercial substitutes, which puts regulators in a difficult position.
Health risks and climate contradictions
The health impacts of PFAS are well-documented. According to the Environmental Protection Agency (EPA), exposure to elevated levels of these chemicals is linked to increased risks of cancer, reproductive problems, hormonal disruption, and weakened immune systems. For communities downstream, the stakes are high.
The lawsuit also targets Micron's Title V air permit. State regulators had previously acknowledged that the facility's greenhouse gas emissions would conflict with New York's climate goals, yet they approved the permit anyway, citing national security concerns. This contradiction has angered environmental advocates who see it as a dangerous precedent.
“We're seeing a pattern where big tech gets a pass on environmental rules,” said a representative from Jobs to Move America. “That's not acceptable, especially when it affects our water and air.”
Despite the legal challenge, construction on the 1,400-acre campus began in January, with the first concrete poured in July 2026. The site is designed to eventually house four fabrication units, creating 9,000 direct jobs and over 40,000 supply chain jobs. The first chips are expected to roll out by 2030.
This isn't the first time that large industrial projects have sparked community resistance. In East Fishkill, New York, data center projects were frozen over similar concerns about water and utility strain. And New York has halted large data centers to protect residents from rising electricity costs. The Micron case, however, is unique because of its scale and the direct threat to a major waterway.
The Oneida River is a vital resource for the region, feeding into Lake Ontario and providing drinking water for many communities. The lawsuit argues that allowing PFAS to enter this watershed without enforceable limits is a violation of the public trust.
As the legal process unfolds, the outcome will set a precedent for how the U.S. balances the push for domestic chip manufacturing with environmental protection. For Latino residents in the area, many of whom work in construction and manufacturing, the issue is personal. They want good jobs, but not at the expense of their families' health.
“We need to think about the long term,” said a local community organizer. “What good is a job if you can't drink the water?”
The court's decision, expected in the coming months, will be closely watched by environmental groups, industry leaders, and policymakers across the country. It could reshape how permits are issued for large-scale industrial projects, especially those involving hazardous chemicals.
For now, the community remains vigilant. As one resident put it, “We're not going to let our river become a dumping ground.”
